End User License Agreement

This End User License Agreement ("Agreement") is between you and Proxyman LLC ("Proxyman," "we," "us," or "our"), 1209 Orange Street, Wilmington, Delaware 19801, United States. It covers TCP Viewer for macOS, our official builds, paid-plan activation, license keys, updates, and related support.

By purchasing or activating a paid plan, or by using the related licensing services, you agree to this Agreement. If you accept it for a company or other organization, you confirm that you have authority to bind that organization.

1. GPL software and paid plans

TCP Viewer source code and the TCP Viewer binaries that we distribute with GPL-covered Wireshark libraries are licensed under the GNU General Public License version 2 or any later version (GPL-2.0-or-later). The GPL governs your rights to use, copy, modify, and redistribute that software.

This Agreement does not add restrictions to rights granted by the GPL. If this Agreement conflicts with the GPL for GPL-covered software, the GPL controls. A paid plan is a separate commercial entitlement to activate PRO features in our official builds and use our licensing, update, and support services. Buying a plan is not required to exercise rights that the GPL grants for a copy you receive under the GPL.

2. Paid-plan entitlement

Subject to this Agreement and payment of the applicable price, a paid plan provides the following device entitlement:

• Standard: one activated Mac.
• Combo Deal: two activated Macs.
• Lifetime Deal: two activated Macs with update coverage for the lifetime of the TCP Viewer product.
• Team: one shared key for one organization, with one activated Mac per purchased seat and a minimum initial purchase of five seats.

Individual plans may be used for personal or business work. A Team key may be shared only with employees and contractors using TCP Viewer for the licensed organization's work. Team seats may be reassigned within that organization. Affiliates, clients, and separate legal entities need their own entitlement unless we agree otherwise in writing.

The device and seat limits shown in your order confirmation and License Manager form part of your paid-plan entitlement.

3. Activation and seat management

Activation requires a valid key and an internet connection. The app contacts the TCP Viewer licensing service to validate the key and register an app-specific device identifier, device name, app version, macOS version, and related activation details.

You may move a seat by removing or revoking the old Mac before activating another one. The owner of the purchase email controls License Manager access and may view and revoke devices attached to the license. You are responsible for keeping keys and access links secure and for removing access when a person no longer works for the licensed organization.

Team Macs must complete a successful online verification at least once every seven days. A temporary connection failure does not immediately end access, but Team access pauses when the signed offline deadline passes. A revoked Mac loses access on its next successful check. Standard, Combo, and Lifetime Deal plans do not have this periodic Team verification deadline.

The app version that introduces signed receipts may require one online verification to migrate an existing activation.

4. Perpetual use, updates, and renewal

Standard, Combo, and Team plans include one year of update coverage from the purchase date unless checkout states otherwise. A covered release is a TCP Viewer version published on or before the plan's update date. Your entitlement to use covered releases does not expire solely because update coverage ends. Team use remains subject to the seven-day verification rule.

"Perpetual" means that the paid entitlement for covered releases has no recurring license fee and no scheduled end date. It does not promise that we will operate licensing, download, update, or support services forever, or that a covered release will remain compatible with future hardware, macOS versions, or third-party components.

Lifetime Deal plans include updates for as long as we continue to develop and release TCP Viewer as a product. "Lifetime" does not mean the lifetime of a person, device, company, operating system, or third-party dependency.

Renewal is optional and manual. It does not create a subscription or automatic charge. A renewal covers every current seat on the license and adds one year after the later of the existing update date and the renewal date. It becomes available within six months before the update date or after that date. Adding Team seats does not change the existing update date. The price, currency, seat count, discounts, and taxes shown in the checkout order summary control that transaction.

Self-service Team purchases support 5 to 100 seats. The self-service service does not support reducing Team seats or converting an individual plan into a Team plan. Contact us for other arrangements.

5. Free and trial builds

Our official build may offer free, trial, or limited functionality before paid activation. We may change those limits or which PRO features require activation in future official builds. This does not change the GPL rights for software distributed under the GPL.

6. License keys and service restrictions

The following restrictions apply to license keys, access links, signed receipts, and our online services. They do not restrict conduct permitted by the GPL for GPL-covered software.

You may not:

• Share an individual key with another person or share a Team key outside the licensed organization.
• Sell, rent, sublicense, publish, or distribute a key, access link, activation credential, or signed receipt.
• Forge, replay, alter, or obtain activation credentials or paid service access without authorization.
• Evade seat limits in our licensing service or use another customer's entitlement.
• Interfere with or overload checkout, licensing, update, download, support, or License Manager services.
• Use TCP Viewer or our services in violation of applicable law or the rights of others.
• Remove or misuse Proxyman or TCP Viewer trademarks or falsely suggest our endorsement.

7. Packet captures and your content

You are responsible for packet captures, pcap and pcapng files, exported sessions, logs, and other content that you create, inspect, import, or share.

Only capture traffic that you are authorized to inspect. Network traffic may contain personal, confidential, security-sensitive, or regulated information. You are responsible for applicable laws, contracts, workplace rules, and security obligations.

TCP Viewer is not designed to upload packet contents or capture files to Proxyman. See the Privacy Statement for the data used by diagnostics, licensing, checkout, and support.

8. Third-party services and components

TCP Viewer uses open-source components and may use third-party services for payment processing, crash reporting, infrastructure, and transactional email. Open-source components remain subject to their own licenses. Third-party services may have separate terms and privacy policies.

Stripe-hosted Checkout processes payments. Sentry may process optional crash diagnostics. Apple and macOS terms also apply where relevant.

9. Ownership and trademarks

Copyright in TCP Viewer code belongs to its respective copyright holders and is licensed as stated in the repository and accompanying notices. Proxyman and its licensors retain their rights in the TCP Viewer name, logos, website, official signing identities, licensing service, documentation, and other materials not distributed under an open-source license.

No paid plan transfers ownership of our trademarks, services, or other proprietary materials.

10. Support and refunds

Paid plans include email support, but we do not promise a specific response or resolution time unless a separate written agreement says otherwise.

We offer a seven-day refund period for eligible direct purchases. Contact us with the purchase email and license details. We may deny requests outside that period or requests involving fraud, abuse, repeated refunds, or chargeback misuse. This policy does not limit refund, withdrawal, warranty, or other consumer rights that cannot be waived under applicable law. Purchases made through another seller are also subject to that seller's refund process.

11. Suspension and termination

You may stop using a paid plan at any time. We may suspend or terminate a key or access to our services if you materially breach this Agreement, misuse another customer's entitlement, commit fraud, abuse a refund or chargeback process, attack the services, or use them unlawfully.

Termination of this Agreement ends the commercial entitlement and related services. It does not terminate GPL rights except as the GPL itself provides. Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and general terms, will survive.

12. Warranty disclaimer

TCP Viewer, paid-plan features, and related services are provided "as is" and "as available." To the extent permitted by law, Proxyman disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation. The GPL also contains warranty terms for GPL-covered software.

Packet analysis can involve incomplete captures, complex protocols, third-party behavior, and operating-system limits. Verify results before relying on them for production, security, legal, or business decisions.

Nothing in this Agreement excludes a warranty or remedy that applicable law does not allow us to exclude.

13. Limitation of liability

To the extent permitted by law, Proxyman will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, business, or substitute services arising from TCP Viewer, a paid plan, or the related services.

To the extent permitted by law, Proxyman's total liability for claims related to a paid plan or the related services will not exceed the amount paid for the plan that gave rise to the claim during the 12 months before the event giving rise to liability.

These limits do not apply to liability that cannot be limited or excluded under applicable law, including liability for fraud, willful misconduct, or death or personal injury where the law so requires.

14. Export and legal compliance

You are responsible for export control, sanctions, privacy, cybersecurity, employment, and other laws that apply to your use. You may not use TCP Viewer or our services where prohibited by law.

15. Changes to this Agreement

We may update this Agreement to reflect changes in the product, services, law, or security requirements. We will change the "Last updated" date and provide additional notice when required by law. Changes do not retroactively reduce paid-plan rights already purchased unless required by law, needed to protect the services or other users, or agreed with you.

16. Governing law

Delaware law governs this Agreement, without regard to conflict-of-law rules. Courts located in Delaware will have exclusive jurisdiction, unless applicable consumer law gives you the right to bring a claim elsewhere. Mandatory laws in your place of residence remain in effect.

17. General terms

If a provision is unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue. A failure to enforce a provision is not a waiver. You may not assign a paid plan outside the transfer rights stated here without our written consent. We may assign this Agreement as part of a merger, acquisition, reorganization, or sale of the relevant business or assets.

This Agreement, the Terms of Service, the Privacy Statement, the order summary, and any separate written agreement between you and Proxyman are the complete agreement for the paid plan and related services. The GPL remains the complete license for GPL-covered software.
